Whether you desire to change your name after a divorce or other personal reasons, the State of Florida maintains your right to legally change your name. While a name change for an adult does not require another party’s consent, a name change for a child will typically require the consent of both parents or proper notice be given.   1. Obtaining Criminal Background Check:

    • Obtain a criminal background check is required as part of the Name Change process. In Florida, you are required to submit a set of fingerprints for a state and national criminal history records check.

  2. Preparing and Filing the Petition for Change of Name:

    • We can assist you in preparing and filing the required Petition for Change of Name along with any required attachments. There is also typically a filing fee charged by the county clerk of court. The Petition includes

    • Notification of Parties:

      We can assist you in notifying relevant parties if applicable and preparing and filing their consent with the Court if received.

  3. Attend the Hearing:

    • Attend the scheduled court hearing. Once the Court has received all necessary documents, an hearing is usually set. The judge will review your petition, ask questions, and decide whether to grant the name change.

    • The judge will verify the name change is not being requested for any illegitimate, fraudulent, or illegal purpose.

  4. Obtain Certified Copy of Order:

    • Once the name change is approved, we can assist you in obtaining a certified copy of the order.

  5. Update Identification and Records:

    • Use the certified copy of the order to update your identification, such as driver's license, Social Security card, and other relevant records.

  6. Notify Other Agencies:

    • Notify other relevant agencies and institutions of your name change, such as banks, employers, and utility companies.
