Uncontested Divorce

Sometimes people make the decision to separate, but wish to avoid the stress, cost, time, and adversarial nature of traditional divorce. In those cases, an uncontested divorce may be right for you. If marital assets have already been separated and there are no children of the marriage, then an uncontested divorce can make a usually complicated and lengthy process much more streamlined.

An uncontested divorce may still be appropriate for you if you and your spouse have not yet split assets but can come to an agreement on how joint property should be separated. This will avoid a judge making the decision for the parties through a process known as equitable distribution. There are many times where the parties and a judge may not reach the same conclusion as to equitable distribution, so it is often in the best interest for the parties themselves to divide the assets through a Marital Settlement Agreement (“MSA”). This agreement can be customized to the specific assets, liabilities, and circumstances of the parties.
